In California, to qualify for as a summary dissolution of your marriage or domestic partnership you must meet all of the following requirements. You and your spouse or domestic partner:
- Both want to terminate your marriage or domestic partnership
- Have not been married or a registered as a domestic partnership for more than 5 years as of the date of separation
- Have no children together born or adopted before or during the marriage or domestic partnership (and neither of you is currently pregnant)
- Have no interest/ownership in real estate
- Do not owe more than $6,000 for debts acquired since the date of your marriage or domestic partnership (except car loans)
- Have less than $50,000 worth of property acquired during the marriage or domestic partnership (except cars)
- Do not have separate property worth more than $40,000 (except cars)
- Agree that neither spouse or partner wants spousal support from the other
- Will agree to sign an agreement that either divides your property and debts or you agree there is no community property or debts to divide
